The U.S. FIFRA Federal Pesticide, Fungicide, and Rodenticide Act was enacted in 1947 and is included in U.S.C. Chapter 7, Section 136. It stipulates that all insecticides and sterilants sold in the United States or exported to the United States, disinfection and bacteriostatic appliances, insect and bird repelling equipment, and air sterilization and purification equipment belong to the EPA controlled products of the United States Environmental Protection Agency. To control:
1. For insecticide and sterilization products (chemical substances are used) such as pesticides, herbicides, antibacterials, etc., these products need to be registered in accordance with the FIFRA directive.
2. For the disinfection, sterilization, insect repellent and Pesticide Device (Pesticide Device) that uses physical methods to achieve predetermined functions (such as UV or ozone), only enterprise registration is required.
1. EPA-controlled electrical products and equipment (Regulated Devices) include:
Ozone sterilizer, UV sterilizer lamp, UV water quality filter, UV air filter, UV mosquito lamp, ultrasonic insect repellent equipment, UV sterilizer, high frequency bird repellent, electronic mouse repellent, air sterilization purification equipment and pest control The manufacturers of electrical appliances and other equipment that use physical functions to achieve disinfection and insecticides also need to apply for and complete the enterprise registration with the EPA, obtain the EPA manufacturer's establishment number (Establishment Number), and provide the first export report and subsequent annual reports.
2. Application for Establishment No. Application Manufacturer Establishment Number:
According to the requirements of the FIFRA Act, manufacturers of these controlled devices must first obtain a company number (company number, usually composed of 5 digits XXXXX) through EPA;
After obtaining the establishment number of the manufacturer issued by the EPA (Establishment Number, the establishment number of the manufacturer is composed of the company number plus the country and factory identification suffix, for example, XXXXX-CHN-01), the first export report (Initial) must be completed within 30 days. Report);
Subsequent annual production reports must be submitted by March 1.
In addition, in accordance with the FIFRA statute and 40 CFR Part 156 of the Code of Federal Regulations, the labelling and product information for these regulated devices are also required to meet the following requirements:
The instruction manual must make a rigorous and correct declaration of the performance of the product, and cannot use any statements that may be misleading or deceptive;
The label must be printed with the EPA Manufacturer's Establishment Number;
Product packaging needs to meet the requirements of FIFRA section 25(c)(3);
Products must have relevant warnings, etc.
Basic process:
1: Apply for an EPA company number;
2: Apply for an Establishment Number;
3: After successful registration - submit the previous annual report within one month;
4: The EPA Form3540-1 application form needs to be submitted for export customs clearance;
5: Submit the previous annual report before March 1 of the second year.
